A.M. Vitals: Gilead to Pay About $10.4 Billion For PharmassetCategories: Wall Street Journal
Pharma Deal: Gilead will pay about $10.4 billion — about $11 billion, including options — for drug developer Pharmasset, the WSJ reports. Pharmasset’s board has approved the deal, which values the company at $137 per share, an 89% premium to Friday’s closing price. Pharmasset said last month it was expanding a trial of a treatment for hepatitis C and Gilead is also pursuing therapies for the disease, the paper says.

Killing Fat Cells in Monkeys: A study published in Science Translational Medicine finds that a drug previously shown to cause weight loss in obese mice by killing certain fat cells can do the same in obese monkeys, raising hopes it might also work in humans, the WSJ reports. For those keeping score of the health-care overhaul law’s record in U.S. appeals courts, the tally now stands at three rulings for the Obama administration and one for the law’s opponents.
As the WSJ reports, the U.S. Court of Appeals for the District of Columbia Circuit ruled 2-1 that the health law’s individual mandate — that’s the requirement that most people carry health insurance or pay a penalty — doesn’t violate the Constitution.

Appeals Court Rules Against Health-Care Overhaul LawCategories: Wall Street Journal
Two U.S. appeals courts are now at loggerheads over the constitutionality of the health-care overhaul law.
As the WSJ reports, the U.S. Court of Appeals for the 11th Circuit in Atlanta ruled 2-1 that the individual mandate to purchase health insurance (or, of course, face a penalty), violates the Constitution. No Hearing: The Supreme Court yesterday rejected an appeal from insurers and other payers who said they paid too much for Eli Lilly’s antipsychotic drug Zyprexa because the drug company misrepresented the benefits of the medication, the WSJ reports. A lower court had ruled that there wasn’t a sufficient link between the high prices and Lilly’s marketing practices; the Supreme Court won’t hear a challenge to that ruling.
